Abstract

With the rapid development of artificial intelligence technology, algorithmic generated art has transformed into an important form of contemporary art creation. The elements such as the randomness feature in the creative process, the attribution of authorship, and legal definitions have attracted widespread attention. This article analyzes algorithmic generated art from the perspectives of artistic creation and legal theory, systematically examining the technical paths, ethical boundaries of the control of randomness in algorithmic generated art. It focuses on discussing the impact of key elements such as the degree of algorithmic intervention, the expression of creative intentions, and the judgment of the originality of the work on the determination of authorship rights. The study holds that the determination of authorship rights in algorithmic generated art should comprehensively consider the intention dominance of human creators, the controllability of algorithmic tools, the original expression of the work, rather than simply denying or affirming the dominant position of the algorithm. This research provides strong support for the creative practice of algorithmic generated art and offers a theoretical basis for the improvement of the copyright system in the digital era. It has significant theoretical value, and its practical significance cannot be ignored.
